If all contributors knew from the beginning that they were to be used to develop the game as GPL only to go closed source later, then nobody has anything to complain about. It seems to be a betrayal of the open source community however, but at least this gives anyone who cares the opportunity to fork the project. I hope it is forked.

@Joe:
wrong, many of the components used in many games are GNU LGPL.

I don't see nothing strange in this movement, as Nintendo,Sony, etc doesn't want GPL code at all on games released for their plattforms.
I hope they will be able to port it to OpenPandora, unless someone takes gpl code and do it before, ;)

What they did was legal, for the closed source port they're using a licensed version of the darkplaces engine. They're not even using the original nexuiz gpl'd engine.

Either read the whole article and try to understand what's going on, or shutup.
look at this as whatever achievement it is for nexuiz a free linux opensource game getting more fame. And nexuiz for pc stays free because the closed source and opensource are effectively different games with similarities and the same name.

But, no, commenters put it "we didn't read the whole article and don't really understand/it would be wrong for this game to get bigger/this is against the opensource philosophy/the devs should keep this game small fry forever". UUUgh

The GNU GPL protection is easily worked around if contributors share/give their rights to one person or company. But in this case, we are made aware of it.
The ultimate treason in open source software would be secretely granting a person/company to close the source without telling anyone. That so much evil, that it would turn some of us in monsters (such evil is a dangerous guys factory).
The only chance GPLed nexuiz has, is that contributors start to improve it, and do *not* give away their rights.

If any of the open source GPL code is modified in the new Game, it will be classed as a derivative work and must also be Open Sourced. They CANNOT close it off other wise they are in breech of the GPL.

This is absolutely set in stone. Look at the Busybox project for examples.

Unfortunately as explained they can do this.
Apart from the GPL license the contributors are obligated to give the "rights" for their work to the "main team" - Alientrap.
And they on their side could do what they want with it - except closing the already GPLed code.
So there is the original GPLed Nexuiz which will remain free and there would be the "closed console port".

Can they really do this? Did _all_ contributors agree?

And aren't all earlier GPL'ed releases still GPL, because they are released as such?

Reminds me a bit of the mambo/joomla story. Well, we know how that ended...
